1. GENERAL

1. “You”, “Your” mean the user of the Application.
2. “9Lives” means a software application developed by PT Nine Lives Indonesia that serves as a means to find and purchase insurance policies and claim for insurance money under the trade name of 9Lives.
3. PT Asuransi Wahana Tata” means a company in general insurance business which issued various general insurance products.
4. “We”, “us” and “our” mean PT Asuransi Wahana Tata (“9Lives”), a company established under the laws of the Republic of Indonesia.
5. “the Application” means a software application we have developed that offers you a simple way to purchase insurance policies covering daily activities and to claim for insurance money without complicated paper forms(our “Service(s).”)
6. We will make every reasonable effort to offer you.

2. TERMS FOR USING THE APPLICATION

1. You represent and warrant that you are an individual legally entitled to give approval under the laws of the Republic of Indonesia, in particular the Terms of Use, to use the Application and that you are at least 17 years old and not under guardianship. Otherwise, we will be entitled by law to cancel any policyentered into with you. You further represent and warrant that you have the right, authority and capacity to use the Service and to abide by the Terms of Use. If you are registering on behalf of a legal entity, you also represent and warrant that you are authorized to enter into, and bind the entity to, these Terms of Use and register for the Service and the Application.
2. We collect and process your personal information, such as your name, e-mail address, and mobile telephone number when you sign up. You must provide accurate and complete information, keep the information up to date and agree to provide us whatever proof of identity we may reasonably ask for. If any of the personal information that you have provided to us changes, for example, if you change your e-mail address, telephone number, or if you wish to cancel your account, please update your details by sending your request to us. We will, to the best of our abilities, effect such changes as requested within fifteen (15) business days of receipt of the notice of the change.
3. You can only use the Application once you have signed up with it.
4. Only you may use your own account and you undertake not to authorize others to use your identity or account. You may not assign or otherwise transfer your account to any other parties. You must keep your account and any identification we provide you secure and confidential.
5. You may only have one 9Lives account.
6. Please inform us if you no longer have control of your account, e.g. your account is somehow hacked or your phone is stolen, so that we can cancel your account accordingly. Please note that you are responsible for the use of your account and may be held liable even if it is abused by another person.
7. The information provided by the Application must not be construed as an advice or an offer, the decision to use the Service is entirely yours. You are free to use any other service.
8. You undertake that you will use the Application only for its intended use to obtain the Service. You may not abuse or use the Application for fraudulent purposes or to take unfair advantage.
9. You may not harm, tweak or modify the Application and/or Website or attempt to harm, tweak or modify it in any way whatsoever. We are not liable if you do not have a compatible device or if you have downloaded the wrong version of the Application to your device. We reserve the right to prohibit you from further using the Application should you use the Application with an incompatible or unauthorized device or for purposes other than those for which the Application is intended to be used. You undertake that you will only use an access point you are authorized to use.
10. You will keep confidential and will not abuse the information you receive from using the Application.
11. You understand and agree that your use of the Application will also be subject to our Privacy Policy as may be amended from time to time. By using the Application, you also give your consent as required under our Privacy Policy.
12. We may, in our sole discretion, provide promotions that may be redeemed for benefits related to the use of the Application. You agree that you will only use such promotions for their intended use and will not abuse, duplicate, sell or transfer the promotions in any manner. You also understand that the promotions cannot be exchanged for cash and may expire on a certain date, even before you use them.

3. PAYMENT

1. The download and/or use of the Application is free of charge. We may introduce fees for the download and/or use of the Application at times. We will inform you accordingly about this for you to decide whether you wish to continue using the Application or not. However, the Internet connection required to use the Service and any associated charges (e.g. mobile data expenses) incurred by your use of the Service are your exclusive responsibility and made solely at your expense.
2. You understand and agree that use of the Application may result in charges to you for insurance products or coverage you.We will facilitate your payment of premiums, and/or taxes on behalf of PT Asuransi Wahana Tata. All charges shall be inclusive or applicable taxes as required by law. All charges are final and non-refundable.
3. Payment of premiums is due immediately and payment will be facilitated by the Application using the preferred payment method designated in your account, after which we will send you a receipt via email.

4. REPRESENTATIONS AND WARRANTIES

Service is provided to you strictly on an "as is" basis, including any errors, bugs or other technical issues.You agree that while using our Application and/or Service, your results may vary and you may not achieve any desired results.We expressly disclaim all warranties either express or implied.Our Application, Software, or Service may not be fit for a particular purpose and may not work or be applicable where you reside.We make no representations or warranties as to the reasonable skill and care invested in our Service, satisfactory quality of our Service, merchantability of our Service or that our Service is non-infringing.Furthermore, we do not warrant that the functions contained in the Application or Service will meet any requirements or needs you may have,that the Application or Service will operate error free or in an uninterrupted fashion,that any defects or errors in the Application or Service will be corrected, or that the Application or Service is compatible with any particular platform.We are not obligated to provide you access to our Application and Service.In the event of any problem with the Application or Service, you agree that your sole remedy is to cease using the Application or Service.

5. LIMITATION OF LIABILITY

For Jurisdictions that do not allow us to limit our liability: Notwithstanding any provision of these Terms, if your jurisdiction has provisions specific to waiver or liability that conflict with the above then our liability is limited to the smallest extent possible by law. Specifically, in those jurisdictions not allowed, we do not disclaim liability for: (a) death or personal injury caused by its negligence or that of any of its officers, employees or agents; or (b) fraudulent misrepresentation; or (c) any liability which it is not lawful to exclude either now or in the future.

6. INDEMNITY

You agree to defend, indemnify and hold harmless 9Lives, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• your use of and access to the 9Lives Application and/or Service;
• your violation of any term of these Terms of Service;
• your violation of any third party rights, including without limitation any copyright, property, or privacy right; or
• any claim that any of your Content caused damage to a third party.

This defense and indemnification obligation will survive this Policy and your use of the 9Lives Application or Service. You also agree that you have a duty to defend us against such claims and we may require you to pay for an attorney(s) of our choice in such cases. You agree that this indemnity extends to requiring you to pay for our reasonable attorneys’ fees, court costs, and disbursements. In the event of a claim such as one described in this paragraph, we may elect to settle with the party/parties making the claim and you shall be liable for the damages as though we had proceeded with a trial.

7. INTELLECTUAL PROPERTY RIGHTS

The design of the Application and Site, along with 9Lives created text, templates, scripts, graphics, interactive features and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to 9Lives, subject to copyright and other intellectual property rights under Republic of Indonesia and foreign laws and international conventions. 9Lives reserves all rights not expressly granted in and to the Service and the Application. You agree to not engage in the use, copying, or distribution anything contained within the Application and Site or Service unless we have given express written permission.

8. TERMINATION

We may terminate or suspend your Account, or our Application, Site, and/or Service without notice, though we will strive to provide a timely explanation in most cases. Please be aware that if we terminate service, you may be entitled to a refund if applicable. All provisions of this Policy which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

3. “Personal Information” means personally identifiable information about You that may be collected through the Application, such as Your name, address, date of birth, gender, occupation, telephone number, email address and/or the like, and other information that may enable identification of a specific individual who is using the Application.
4. “We”, “Us” and “Our” mean PT Asuransi Wahana Tata, a company in general insurance business which issued various general insurance product.
5. “Nine Lives Indonesia” means PT Nine Lives Indonesia, a company established under the laws of the Republic of Indonesia which develops the Application.

2. INFORMATION WE COLLECT

We collect certain Personal Information from You for the Application to purchase insurance policies and claim for insurance money. You will directly provide some Personal Information and some will be collected automatically when You use the Application.

Information You provide directly, are:

1. Upon signing up with the Application, You will provide Us your e-mail address and account name.
2. When You use the Application to purchase insurance policies, You provide Us information such as your gender, place and date of birth and phone number, and to claim for insurance money,You provide Us information such as Your bank name and bank account number.
3. You can share your invitation code with your friends through the Application, for which, We will only prepare a message for You to send or publish through your social media or email provider. We do not collect your friend's information.

Information We collect when You use the Application, are:

1. When You use Our Application, We also process technical data such as your IP-address, device ID and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable Us to deliver the functionalities of the Application, resolve technical difficulties, provide You with the correct and most up to data version of the Application and to improve the function of the Application.

3. USING THE INFORMATION WE COLLECT

1. We use your email address, name, phone number and/or account password to verify your ownership over an account in Our Application, to communicate with You in connection with the use or management of the service and to give You information regarding the Application. We may also use your name, email address and phone number to send message, general update of the Application, special offers or promotions.
2. We use your Personal Information in an aggregated form to closely monitor which features of the services are used the most, to analyze usage patterns and to determine where We should offer or focus Our services. You hereby agree that your data will be used for Our internal data processing to provide better services to You.

4. SHARING THE INFORMATION, WE COLLECT

1. Your Personal Information may be transferred to, stored, used and processed in a jurisdiction other than Viet Nam where Our servers are located. You understand and consent to the transfer of your Personal Information out of Viet Nam.
2. We do not sell, rent or lease your Personal Information to other people or non-affiliated companies.
3. You hereby agree and authorize Us to store, use, and process your Personal Information as part of the provision of the services of the Application and for the purpose of future marketing activities.

5. RETAINING THE INFORMATION, WE COLLECT

We will retain your information until You cancel your account in the Application.

6. SECURITY

Confidentiality of your data and personal information is the most important matter for Us. We store and protects your personal information at the system servers and is secured by a firewall system and establishes and protects the connecting information exchange and transactions using SSL technology. We will conduct the best effort and steps to protect and secure your data and personal information. However, We cannot fully guarantee that our system is totally impenetrable by virus, malware, disruption or extraordinary occurrence including unauthorized access by a third party. You may not lend your account to anyone and must always maintain the security of the device You use

7. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy to reflect changes in our practices. If We do so, We will notify You of significant changes via email or by means of a notice on the Application 1 (one) day before the change becomes effective. We encourage You to periodically review this page for the latest information on Our privacy practices.

8. MISCELLANEOUS

Governing Law and Jurisdiction. This Privacy Policy shall be regulated and interpreted pursuant to the laws of the Socialist Republic of Viet Nam. Any and all disputes arising from this Privacy Policy shall be governed by the exclusive jurisdiction of the South Jakarta District Court.

9. ACKNOWLEDGEMENT AND CONSENT

1. By using the Application, You acknowledge that You have read and understood this Privacy Policy and the Terms of Use and agree and consent to the use, practice, processing and transfer of your personal data by Us as described in this Privacy Policy.
2. You also represent that You have the right to share all the information You have provided to Us and to give Us the right to use and share the information with the affiliated companies to provide the products or services You request if We have your consent, or in the following situations:
   • We respond to court summons, court orders, or legal proceedings, or establish or exercise Our legal rights or defend against legal claims.
   • We believe that it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, alleged fraud, situations involving possible threats to the physical safety of any person, violation of the Terms of Use or as otherwise required by prevailing laws and regulations.
